BUILDING PERMITS
A HOME OWNERS'S GUIDE
Aim And Application Of This Guide
This guide is intended to help you, the homeowner, to better understand the steps to follow in obtaining a building permit.
This is a guide only and is not intended to be a substitute for the Municipal Building By-laws, the Ontario Building Code or any other applicable law. If you have any questions, please contact our office at 613-473-4030.
Why Do I Need A permit?
Building permits are necessary to ensure that zoning requirements, fire and structural safety standards and other building standards are met, primarily for safety reasons.
Who is responsible for obtaining a permit?
It is the homeowner's responsibility to ensure that a building permit is obtained when required.
You may authorize your contractor or designer to apply for the permit, but the owner should ensure that they have the permit prior to any work starting.
What Happens If I Build Without A Permit?
To construct or demolish without a permit is against the law and is subject to fines or penalties as set out in the Building Code Act. The Municipality of Centre Hastings Building By-law sets out a surcharge of $200.00 for construction without a permit.
“construct” means
to do anything in the erection, installation, extension or material alteration or repair of a building and includes the installation of a building unit fabricated or moved from elsewhere
“demolish” means
to do anything in the removal of a building or any material part thereof
What Is A Building?
“building” means
-
a structure occupying an area greater than ten square metres consisting of a wall, roof, and a floor or any of them or a structural system serving the function thereof including all plumbing, works, fixtures and service system appurtenant thereto,
-
a structure occupying an area of ten metres or less that contains plumbing appurtenant thereto,
-
plumbing not located in a structure,
(c.1) a sewage system: or
-
a structure designated in the building code
What Projects Require A Building Permit?
The following is a list of typical projects that require a permit:

decks (including swimming pool enclosure)
-
all new buildings or replacement of existing
-
new fireplaces
-
completion of roughed-in fireplaces
-
installation of wood burning stoves and outdoor furnaces
-
porches
-
sunrooms
-
solariums
-
carports
-
attached or detached garages, sheds
-
dormers or finishing attic space
-
one or two storey additions
-
finishing a basement
-
furnace and duct work replacements
-
interior structural alterations
-
a change of use
-
designated structures as defined by the Ontario Building Code
-
adding or removing most walls, i.e. creating different room sizes and/ or use
-
basement or main floor walkout alterations
-
replacement of brick veneer
-
replacement of masonry chimney below roofline
-
installation, repair of storm, sanitary and water service
-
installation of cleanouts
-
installation of a new septic system
-
repair or replacement of an existing septic system
-
plumbing and/or drains (except replacing fixtures)
-
structural alterations to windows or doors
-
to demolish
What Projects Do Not Require A Building Permit?
The following is a list of typical projects that do not require a permit:

a detached accessory structure (gazebo, shed, etc.) which is less than 10 sq. m (108 Sq. ft.) in area and does not contain plumbing

fences other than for swimming pools (Note: the Mun. does have a fence by-law, copies are available at the Mun. office)
-
asphalt roof shingling
-
eavestroughs
-
minor repairs to masonry
-
damp proofing a basement
-
kitchen or bathroom cupboards
-
free-standing satellite dishes
-
replacing siding or windows (provided there are no structural changes)
-
decks not forming part of a principle entrance to a dwelling and less than 600mm (24 inches) above grade
-
air conditioning units or heat pumps added to existing forced-air systems
-
replacing existing forced-air furnace (no duct work alterations)
-
pool heaters
-
painting and decorating
-
landscaping
NOTE: Although A Building Permit May Not Be Required, You Must Still Comply With The Requirements Of The Zoning By-Law And The Building Code
